I have not appointed a data protection officer, as the statutory thresholds for doing so are not met (Art. 37 GDPR, § 38 BDSG).

2. General information

The protection of your personal data is important to me. Personal data is collected on this website and in the course of my business activity only to the extent necessary for the respective purpose and is processed exclusively on the basis of legal requirements (GDPR, BDSG, TDDDG).

3. Hosting and server log files

This website is hosted by: STRATO AG, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany.

When the site is accessed, server log files are automatically recorded by the host (IP address, date, time, requested URL, referrer, browser/OS). The legal basis is Art. 6(1)(f) GDPR; my legitimate interest is the stable and secure delivery of the website. The log files are stored for a maximum of 7 days and then deleted automatically, unless concrete indications of a security incident require longer retention. A data processing agreement pursuant to Art. 28 GDPR is in place with STRATO. Processing takes place exclusively on servers located in Germany.

4. Contact form (Tally)

For the contact form I use the service Tally by Tally B.V., Stadhouderskade 55, 1072 AB Amsterdam, Netherlands. The form is loaded only after you actively click “Get in touch”; no script is transmitted from tally.so and no information is stored in your browser before that. A separate consent prompt is therefore not required — activation takes place through your deliberate action.

The data you enter (e.g. name, email address, message, and any further information you provide) is transmitted to Tally and forwarded to me in order to respond to your enquiry.

The transmitted data is deleted as soon as your enquiry has been finally processed and no statutory retention obligations require longer storage (see Section 5).

5. Contact by email and telephone

If you contact me outside this website — for example by email to mail@jan-fietz.de or by telephone at +49 5031 5194041 — I process the personal data that arises in the process in order to respond to your enquiry and, where applicable, to initiate or perform a business relationship.

Categories of data processed:

  • Your name and, where applicable, your company
  • Your contact details (email address, telephone number, postal address where provided)
  • The content and context of your enquiry, and any further information you choose to share voluntarily (e.g. project description, technical context)
  • For emails, additionally technical metadata such as date, time, and mail headers

Purposes of processing:

  • Responding to your enquiry
  • Initiating, concluding, and performing a service or work contract
  • General business correspondence

Legal bases:

  • Art. 6(1)(b) GDPR, where processing is necessary to take pre-contractual measures at your request or to perform a contract with you.
  • Art. 6(1)(f) GDPR otherwise, in particular for general business enquiries without a direct contractual link. My legitimate interest is the ability to handle incoming enquiries properly and to communicate with business partners, prospects, and clients. A weighing of interests shows that your protected interests do not override this, because you have actively contacted me and the processing is limited to what is necessary to respond.

Storage location:

Emails are stored in my business mailbox hosted by STRATO AG (Germany). Telephone contact details and call notes, where required for handling the enquiry, are stored in an internal, non-publicly accessible wiki/CRM system. I operate this system myself, and it runs on a server provided by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. Data processing agreements pursuant to Art. 28 GDPR are in place with both providers (STRATO and Hetzner); processing takes place exclusively on servers located in Germany. I do not use any external customer-relationship-management system.

Retention:

  • Data from contact enquiries that do not lead to a contract is deleted no later than twelve months after the correspondence ends, unless a longer retention obligation applies or you have agreed to longer storage.
  • Business correspondence that has led to the initiation, conclusion, or performance of a contract is retained in accordance with German commercial and tax retention periods — in particular six years for commercial letters (§ 257(1) no. 2, (4) HGB) and ten years for accounting records and tax-relevant documents (§ 147(1), (3) AO).
  • After these periods have expired, the data is deleted unless it is exceptionally still required.

Providing this data is voluntary. Without it, however, I cannot respond to your enquiry or perform a contract with you. You may object at any time to processing based on Art. 6(1)(f) GDPR pursuant to Art. 21 GDPR.

6. Fonts

The fonts Geist Sans and Geist Mono are served locally from this server. No connection is made to third-party providers such as Google Fonts. No cookies are set and no data is transmitted to third parties as a result.

7. Cookies and local storage

This website does not set its own tracking cookies and uses no analytics or marketing tools. Tally may set technically necessary cookies when the contact form is opened — for details see Tally’s privacy policy (see Section 4).

The website uses the browser’s localStorage solely to store your chosen theme preference (light/dark). This information remains in your browser and is at no point transmitted to me or any third party. Access takes place on the basis of § 25(2) no. 2 TDDDG, as the storage is strictly necessary to provide a service you have expressly requested (display in the chosen mode). Consent is not required. You can delete the entry at any time via your browser settings.

8. Your rights as a data subject

You have the right at any time to:

  • Information about the personal data processed about you (Art. 15 GDPR)
  • Rectification of inaccurate data (Art. 16 GDPR)
  • Erasure of your data (Art. 17 GDPR)
  • Restriction of processing (Art. 18 GDPR)
  • Data portability (Art. 20 GDPR)
  • Object to processing based on Art. 6(1)(f) GDPR (Art. 21 GDPR)
  • Withdraw a given consent with effect for the future (Art. 7(3) GDPR)

To exercise these rights, an informal message to the contact details in Section 1 is sufficient.

Without prejudice to other remedies, you also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority competent for me is:

9. Transfers to third countries

No transfer of your personal data to countries outside the EU or the EEA takes place. All processors used (STRATO AG, Hetzner Online GmbH, Tally B.V.) process the data exclusively on servers within the EU.

10. SSL/TLS encryption

For security reasons this website uses TLS encryption. You can recognise an encrypted connection by the lock symbol in your browser’s address bar and the “https” prefix. As a result, transmitted data cannot be read by third parties.
